2024年12月30日、中国国家知識産権局（CNIPA）は改訂後の「国家知識産権局行政復議規程」（第82号局令）を公布した。この規程は2025年2月1日から施行される。
改訂前の「規程」は2012年9月1日に施行されたが、制定から時間が経過し、現在の行政復議業務のニーズに十分に対応できていない部分があった。具体的には、機構改革により、国家知識産権局の再審案件の管轄範囲が商標や地理的表示に拡大した点、新たに調整された知財制度に対応する救済ルールが明確でない点、そして改訂された「行政復議法」に基づいた適応的な修正が必要な点が挙げられる。これらの問題を解決するため、国家知識産権局は規程の改訂を行った。
新しい規程は全5章44条から成り、主な改訂内容は以下の通り。
１、復議業務の基本原則、職責と保障の明確化。
２、行政復議の受理案件の類別と前置範囲の整備。
３、行政復議の受理および審理手続きの最適化。
４、行政復議による行政紛争の解決、法による行政監督の役割の強化。
これの改正により、知的財産権に関する行政復議業務がより効率的かつ適切に進められることが期待されている。
